2. Counter-Notification Procedures

If you believe that the material you posted on the Site was removed or access to it was disabled by mistake or misidentification of the material, you have the right to file a counter-notification with our Copyright Agent. To be effective, your counter-notification must substantially comply with the following requirements, as set forth in Section 512(g)(3) of the DMCA:

  1. Your Physical or Electronic Signature: A physical or electronic signature.
  2. Identification of Removed Material: Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access to it was disabled.
  3. Good Faith Belief Statement: A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
  4. Upon receipt of a valid counter-notification: Prompt Miner will promptly provide the complaining party with a copy of the counter-notification and inform them that we will replace the removed material or cease disabling access to it in 10 business days. Prompt Miner will restore the removed material in 10 to 14 business days or more following receipt of the counter-notification, unless our Copyright Agent first receives notice from the complaining party that they have filed an action seeking a court order to restrain the subscriber from engaging in infringing activity relating to the material on our system.

3. Repeat Infringers Policy

In accordance with the DMCA and other applicable laws, Prompt Miner has adopted a policy of terminating, in appropriate circumstances and at our sole discretion, users who are deemed to be repeat copyright infringers. A repeat infringer is a user who has been notified of infringing activity more than twice and/or has had infringing material removed from the Site more than twice. We reserve the right to remove content and terminate user accounts without prior notice if we determine, in our sole discretion, that the user is a repeat infringer.

4. Modifications to This DMCA Policy

We reserve the right to update, amend, or change the contents of this DMCA Policy at any time and for any reason.
